The Method and Culture of Comparative Law:
Essays in Honour of Mark Van Hoecke
by Maurice Adams (Editor), Dirk Heirbaut (Editor)

Awareness for the need to deepen the methodological foundations of legal research is only recent. The same is true for comparative law, by nature a more adventurous branch of legal research, which is often something researchers simply do, whenever they look at foreign legal systems to answer one or more of a range of questions about law, whether these questions are doctrinal, economic, sociological, etc. Given the diversity of comparative research projects, the precise contours of the methods employed, or the epistemological issues raised by them, are to a great extent a function of the nature of the research questions asked. As a result, the search for a unique, one-size-fits-all comparative law methodology is unlikely to be fruitful. That, however, doesn't make reflection on the methodology and culture of comparative law meaningless. Mark Van Hoecke has, throughout his career, been interested in many topics, but legal theory, comparative law, and methodology of law stand out. Building upon Van Hoecke's work, this festschrift brings together many authors working at the crossroads of these themes: the methodology of comparative law.

Communications, Media and the Imperial Experience:
Britain and India in the Twentieth Century
by Chandrika Kaul  (Author)

Over the course of the twentieth century, the British Raj successfully combined military force and coercion, with modern methods of persuasion, publicity and media manipulation - imperial public relations - in its strategies to engage with the increasingly challenging task of governing its Indian empire. This book focuses on the media environment of empire as a conceptual tool to investigate its political culture and role in shaping the imperial experience. The British national press, Reuters, the BBC, US newspapers and international news agencies such as the Associated Press and the United Press, as well as the Indian media, had a seminal role to play in this process. The interaction of imperial and media cultures is undertaken through in-depth case studies utilising hitherto unseen primary sources and examining the grand pageant of the Coronation Durbar 1911, Gandhian strategies of mass civil disobedience during the 1930s, the new technological revolution of broadcasting and the birth of All India Radio, as well as the endgame of empire and decolonisation in 1947.

The Price of Rights: Regulating International Labor Migration
by Martin Ruhs  (Author)

Many low-income countries and development organizations are calling for greater liberalization of labor immigration policies in high-income countries. At the same time, human rights organizations and migrant rights advocates demand more equal rights for migrant workers. The Price of Rights shows why you cannot always have both.
Examining labor immigration policies in over forty countries, as well as policy drivers in major migrant-receiving and migrant-sending states, Martin Ruhs finds that there are trade-offs in the policies of high-income countries between openness to admitting migrant workers and some of the rights granted to migrants after admission. Insisting on greater equality of rights for migrant workers can come at the price of more restrictive admission policies, especially for lower-skilled workers. Ruhs advocates the liberalization of international labor migration through temporary migration programs that protect a universal set of core rights and account for the interests of nation-states by restricting a few specific rights that create net costs for receiving countries.

The Price of Rights analyzes how high-income countries restrict the rights of migrant workers as part of their labor immigration policies and discusses the implications for global debates about regulating labor migration and protecting migrants. It comprehensively looks at the tensions between human rights and citizenship rights, the agency and interests of migrants and states, and the determinants and ethics of labor immigration policy.

Le nuove norme sulla giustizia penale
by A. Marandola, G. Varraso C. Conti (Author)

Law, Society, and Authority in Late Antiquity
by Ralph W. Mathisen (Editor)

The sixteen papers in this volume investigate the links between law and society during Late Antiquity (260-640 CE). On the one hand, they consider how social changes such as the barbarian settlement and the rise of the Christian church resulted in the creation of new sources of legal authority, such as local and "vulgar" law, barbarian law codes, and canon law. On the other, they investigate the interrelationship between legal innovations and social change.

The Theodosian Code: Studies in the Imperial Law of Late
by Ian Wood (Editor), Jill Harries (Editor)

The Theodosian Code, put together under the Eastern Roman Emperor Theodosius II, is a compliation of the laws dating from 312 to 438 AD, when the code was published. It brought order to a vast unmanageable body of law and formed part of the basis for the sixth-century Institutes of Justinian, fundamental to later jurisprudence. This book is an important collection of articles, well established as an essential resource for students of Roman law, long unavailable and here published in paperback for the first time with a new preface and updated bibliography. Contributors: Simon Corcoran; Brian Croke; Judith Evans Grubbs; Jill Harries; Tony Honore; David Hunt; John Matthews; Boudewijn Sirks; Mark Vessey; Dafydd Walters; Ian Wood.

Law and Authority under the Guise of the Good (Law and Practical Reason)
by Veronica Rodriguez-Blanco

The received view on the nature of legal authority contains the idea that a sound account of legitimate authority will explain how a legal authority has a right to command and the addressee a duty to obey. The received view fails to explain, however, how legal authority truly operates upon human beings as rational creatures with specific psychological makeups. This book takes a bottom-up approach, beginning at the microscopic level of agency and practical reason, and continues on to the justificatory framework of authority. The book argues that an understanding of the nature of legal normativity involves an understanding of the nature and structure of practical reason in the context of the law, and advances the idea that legal authority and normativity are intertwined. This point can be summarized thus: if we are able to understand both how the agent exercises his or her practical reason under legal directives and commands, and how the agent engages his or her practical reason by following legal rules grounded in reasons for actions as good-making characteristics, then we can fully grasp the nature of legal authority and legal normativity. Using the philosophies of action enshrined in the works of Elisabeth Anscombe and Thomas Aquinas, the book explains practical reason as diachronic future-directed intention in action, and it argues that this conception illuminates the structure of practical reason of the legal rules' addressees. The account is comprehensive and enables the reader to distinguish authoritative and normative legal rules in just and good legal systems from 'apparent' authoritative and normative legal rules of evil legal systems. At the heart of the book is the methodological view of a 'practical turn' to elucidate the nature of legal normativity and authority. It is a fascinating read for all those interested in legal philosophy. (Series: Law and Practical Reason) [Subject: Legal Philosophy]

William V. Harris
Due son le porte dei sogni

«Cominciamo nel quarto secolo d.C. in Egitto. Vi piacerebbe comparire nei sogni altrui? Ecco cosa dovete fare.

Cosa significavano i sogni?

Origin of Wealth:
Evolution, Complexity, and the Radical Remaking of Economics
by Eric D. Beinhocker

In the "Origin of Wealth", Eric Beinhocker offers a thorough and convincing new way to think about economic growth and business management. The author begins by exploring the roots of modern economic theory and ultimately declares it outmoded and wrong. Instead, he suggests, markets and growth can best be explained by drawing on the emerging field of complexity economics: the study of markets and social systems as complex adaptive systems.Although biological metaphors in business have become familiar (i.e., organizations are living organisms), Beinhocker moves beyond metaphor to explain the revolutions in science that will inevitably change the way we think about economics, competition, and business. "The Origin of Wealth" raises important questions such as: How can one create strategy in uncertain and fast moving environments? Why is it hard for large organizations to be innovative and how should we organize for better results? And what role should governments play in this new era?

The Calling of Law:
The Pivotal Role of Vocational Legal Education

by Fiona Westwood,  Karen Barton

As one of the 'learned' professions requiring advanced learning and high principles, law enjoys a special standing in society. In return for its status and rank, the legal profession is expected to exhibit the highest levels of honesty, trust and morality, the very values which underpin the legal system itself. This, in turn, entrusts to legal education a particular problem of addressing, not only the substantive elements of the body of law, but a means through which the characteristics of the 'calling' of law are imparted and instilled. At a time when the very essence of the legal profession is under threat, this book calls for a realignment of the legal curriculum and pedagogies so as to emphasise the development of culture over industry; character over eloquence; and calling over skill. Chapters are grouped around the core content and key themes of Curiosity, Calling, Character and Conscientiousness, Contract, and Culture. The volume includes contributions from leading experts, drawn internationally and from other professional disciplines in order to present alternative approaches aimed at tackling common issues, providing insight, and provoking debate.

Applied Nonparametric Econometrics

by Daniel J. Henderson,  Christopher F. Parmeter

Anteprima del libro

The majority of empirical research in economics ignores the potential benefits of nonparametric methods, while the majority of advances in nonparametric theory ignores the problems faced in applied econometrics. This book helps bridge this gap between applied economists and theoretical nonparametric econometricians. It discusses in depth, and in terms that someone with only one year of graduate econometrics can understand, basic to advanced nonparametric methods. The analysis starts with density estimation and motivates the procedures through methods that should be familiar to the reader. It then moves on to kernel regression, estimation with discrete data, and advanced methods such as estimation with panel data and instrumental variables models. The book pays close attention to the issues that arise with programming, computing speed, and application. In each chapter, the methods discussed are applied to actual data, paying attention to presentation of results and potential pitfalls.

Il progetto filiazione nell'era tecnologica.
Percorsi etici e giuridici

Growing Artificial Societies: Social Science from the Bottom Up
von Joshua M. Epstein  (Autor), Robert L. Axtell (Künstler)

How do social structures and group behaviors arise from the interaction of individuals? Growing Artificial Societies approaches this question with cutting-edge computer simulation techniques. Fundamental collective behaviors such as group formation, cultural transmission, combat, and trade are seen to "emerge" from the interaction of individual agents following a few simple rules. In their program, named Sugarscape, Epstein and Axtell begin the development of a "bottom up" social science that is capturing the attention of researchers and commentators alike. The study is part of the 2050 Project, a joint venture of the Santa Fe Institute, the World Resources Institute, and the Brookings Institution. The project is an international effort to identify conditions for a sustainable global system in the next century and to design policies to help achieve such a system. Mind, Reason, and Being-in-the-world:
The McDowell-Dreyfus Debate

Joseph K. Schear

John McDowell and Hubert L. Dreyfus are philosophers of world renown, whose work has decisively shaped the fields of analytic philosophy and phenomenology respectively. Mind, Reason, and Being-in-the-World: The McDowell-Dreyfus Debate opens with their debate over one of the most important and controversial subjects of philosophy: is human experience pervaded by conceptual rationality, or does experience mark the limits of reason? Is all intelligibility rational, or is there a form of intelligibility at work in our skilful bodily rapport with the world that eludes our intellectual capacities? McDowell and Dreyfus provide a fascinating insight into some fundamental differences between analytic philosophy and phenomenology, as well as areas where they may have something in common.

Fifteen specially commissioned chapters by distinguished international contributors enrich the debate inaugurated by McDowell and Dreyfus, taking it in a number of different and important directions. Fundamental philosophical problems discussed include: the embodied mind, subjectivity and self-consciousness, intentionality, rationality, practical skills, human agency, and the history of philosophy from Kant to Hegel to Heidegger to Merleau-Ponty. With the addition of these outstanding contributions, Mind, Reason, and Being-in-the-World is essential reading for students and scholars of analytic philosophy and phenomenology

The Four Freedoms

In the 10 years since its first edition, Catherine Barnard's text has quickly established itself as the leading textbook on the Four Freedoms. Popular with students and academics alike, this authoritative text offers a unique balance of comprehensive, detailed coverage in a concise and readable style. The fourth edition continues to provide a critical and thorough analysis of the key principles of the substantive law of the EU, focusing on the four freedoms. An introductory chapter provides valuable context on the governance of the internal market, its evolution, and the theories behind its key principles. Each of the freedoms is then dealt with in turn, covering goods, persons, services, and capital, before moving on to discuss harmonization, the regulation of the internal market, and its future. Additional useful detail is captured in footnotes, while further reading lists provide support for independent study and research. This thorough coverage is fully supported by engaging case studies throughout the book which place the law in context, helping you to understand the complexities of the subject and exploring the practical implications of EU law. Diagrams, flowcharts, and tables offer further detail and illustrate key ideas and processes in an easily accessible format, while chapter overviews and a clear structure ensure readers remain on track and can find information quickly.
