With more than 158,000 treaties and some 125 judicial organisations, international law has become an inescapable factor in world politics since the Second World War. In recent years, however, international law has also been increasingly challenged as states are voicing concerns that it is producing unintended effects and accuse international courts of judicial activism. This book provides an important corrective to existing theories of international law by focusing on how states respond to increased legalisation and rely on legal expertise to manoeuvre within and against international law. Through a number of case studies, covering a wide range of topical issues such as surveillance, environmental regulation, migration and foreign investments, the book argues that the expansion and increased institutionalisation of international law itself have created the structural premise for this type of politics of international law. More international law paradoxically increases states' political room of manoeuvre in world society.

Drawing on original data, Heidi Nichols Haddad maps and explains the differences in NGO participatory roles, frequency, and impact at three judicial institutions: the European Court of Human Rights, the Inter-American Human Rights System, and the International Criminal Court. In recent decades all sorts of illicit medicines have been increasingly traded world-wide: from antibiotics to weight loss drugs, and antimalarial tablets to steroids. The illicit medicines market is generally associated with considerable health risks for its users, as well as with high revenues and a perceived growing degree of criminal organization. It is therefore important to gain extensive criminological insights into this global market. This book provides in-depth and empirically-grounded theoretical insights into the online and offline trade in illicit pharmaceuticals, with particular reference to lifestyle pharmaceuticals. Trade in the Netherlands and manufacturing in China are taken as extended case studies.  Al giorno d'oggi, l'impatto del diritto dell'Unione si avverte in tutti i settori del diritto. Oltre ad ambiti per i quali il diritto unitario rappresenta da molti anni una presenza rilevantissima (diritto societario, diritto della proprietà industriale, commerciale e intellettuale, diritto del lavoro, diritto dei contratti pubblici, diritto delle imposte indirette, diritto dei trasporti e della navigazione, diritto internazionale privato e processuale, diritto dell'immigrazione), in tempi più recenti si è sviluppato un corpus di norme europee di grande importanza nel campo del diritto e della procedura penale e persino in quello del diritto di famiglia. Basti pensare al mandato d'arresto europeo e alla appena approvata Procura europea o EPPO, secondo l'acronimo inglese. Oppure ai vari regolamenti adottati nell'ambito della cooperazione giudiziaria in materia civile e commerciale che hanno ad oggetto rapporti di tipo familiare. Non meraviglia pertanto che si incontrino contenuti di derivazione unitaria in quasi tutte le materie insegnate nel quadro nei corsi di laurea delle Università italiane ed europee che abbiano un contenuto giuridico. In questo contesto, il compito riservato a studiosi che si dedicano specificamente al Diritto dell'Unione europea è quello di presentare il fenomeno giuridico dell'integrazione in maniera completa e ordinata, secondo una sistematica quanto più possibile chiara e accessibile. Si tratta ormai di un compito arduo, considerando lo sviluppo massiccio che il diritto dell'Unione europea ha conosciuto in quasi settant'anni di vita. Un compito che nondimeno è necessario assolvere e che può essere svolto solo dagli "specialisti", da coloro che hanno osservato e studiato il fenomeno nel suo continuo divenire: dalla Dichiarazione di Robert Schuman del 9 maggio 1950 alla Brexit; dalla Carta dei diritti fondamentali al parere 2/13 della Corte di giustizia sull'adesione alla CEDU; dalle sentenze "pionieristiche" sui casi Van Gend & Loos e Costa c. Enel, alla "saga" sul caso Taricco, conclusasi, per ora, con la sentenza della Corte di giustizia del 5 dicembre 2017, cioè pochi giorni prima dell'uscita della presente edizione. Il volume segue un discorso basato in gran parte sulla giurisprudenza. Numerosissimi sono i casi citati della Corte di giustizia dell'Unione europea, della Corte europea dei diritti dell'uomo e delle Corti costituzionali degli Stati membri maggiori. I leading cases non sono soltanto richiamati per i principi di volta in volta affermati, ma descrivendo la materialità degli aspetti di fatto e di diritto che ciascun caso presenta. La Sesta edizione si avvale, come la precedente, della collaborazione di Stefano Amadeo, Giacomo Biagioni, Cristina Schepisi e Fabio Spitaleri.

Gli atti atipici nel sistema delle fonti del diritto dell'Unione europea

Il processo di integrazione europea si è venuto caratterizzando come unico e originale, per le peculiarità che presenta rispetto ad altre esperienze sovranazionali, in particolare per la previsione di atti normativi idonei ad esplicare la propria efficacia direttamente sui singoli. Oltre alle forme di atti codificate dai trattati, si è affermato nella prassi il ricorso a strumenti non previsti. Con il termine 'atti atipici' ci si è riferiti, pur con alcune differenze, ad atti adottati dalle istituzioni dell'UE, ma non rientranti nelle categorie giuridiche regolate dagli artt. 288-292 Tfue. Tale complesso di atti appare fortemente disomogeneo per effetti, caratteri, procedimenti di adozione, funzioni e solleva numerosi dubbi e problematiche in relazione ad una molteplicità di aspetti. Interrogativi che attengono, tra l'altro, alla loro natura e collocazione nel sistema delle fonti dell'Unione europea, al rispetto dei principi fondamentali che investono l'ordinamento dell'Unione, all'efficacia e alle garanzie di cui dispongono i singoli. A questi, essenziali, profili è dedicato il volume, tenendo conto del quadro evolutivo e della prassi più recente.
