The application of the right to life during armed conflict is an issue that polarizes opinion and generates considerable debate. Many believe that human rights law has no place in armed conflict, yet the European Court of Human Rights, and domestic courts, have ruled that it can apply. The exact contours of how the right to life applies during armed conflict remain largely unresolved. In this text, Ian Park seeks to clearly articulate the right to life obligations of states during both international and non-international armed conflict in respect of those individuals affected by the actions of states' armed forces and members of the armed forces themselves. Smart procurement aims to leverage public buying power in pursuit of social, environmental and innovation goals. Socially-orientated smart procurement has been a controversial issue under EU law. The extent to which the Court of Justice (ECJ) has supported or rather constrained its development has been intensely debated by academics and practitioners alike. After the slow development of a seemingly permissive approach, the ECJ case law reached an apparent turning point a decade ago in the often criticised judgments in Rüffert and Laval, which left a number of open questions.

The more recent judgments in Bundesdruckerei and RegioPost have furthered the ECJ case law on socially orientated smart procurement and aimed to clarify the limits within which Member States can use it to enforce labour standards. This case law opens up additional possibilities, but it also creates legal uncertainty concerning the interaction of the EU rules on the posting of workers, public procurement and fundamental internal market freedoms. These developments have been magnified by the reform of the EU public procurement rules in 2014.

This book assesses the limits that the revised EU rules and the more recent ECJ case law impose on socially-orientated smart procurement and, more generally, critically reflects on potential future developments in this area of intersection of several strands of EU economic law.

While treaties can be notoriously difficult to amend by formal means, they must nevertheless be adapted over time in order to remain useful. Herein lies the role of subsequent practice as a key tool for treaty change. Subsequent practice-a well-established means of treaty interpretation-sometimes diverges from the original treaty provision to such an extent that it can no longer be said to constitute an act of interpretation or application. Rather, it becomes, in effect, one of treaty modification. The modification of treaties by subsequent practice extends to all fields of international law, from the law of the sea, environmental law, and investment law, to human rights and humanitarian law. Such modifications can have significant practical consequences, from revising or creating new rights and obligations, to establishing new institutional mechanisms. Determining when and how treaty modification by subsequent practice occurs poses difficulty to legal scholars and dispute settlement bodies alike, and impacts States' expectations as to their treaty obligations. This significant yet underexplored process is the focus of this book. Modification of Treaties by Subsequent Practice proves that subsequent practice can-under carefully defined conditions that ensure strict accordance with the will of the treaty parties-alter, supplement, and terminate treaty provisions or even entire treaty frameworks. It can also generate customary law and fuel regime interaction. Ultimately, this book demonstrates the relevance and dynamism of the process of treaty modification by subsequent practice, emphasizing the need to deal with the issue head on, and explains-on a theoretical and practical level-how it can be identified and dealt with more consistently in the future. This book explores the large and controversial subject of the use of force in international law. Is there an expanding right of self-defence against non-state actors? Is the use of force effective? The development of nuclear weapons by North Korea has reignited discussion about the legality of pre-emptive self-defence. The NATO-led operation in Libya increased hopes for the implementation of 'responsibility to protect', but it also provoked criticism for exceeding the Security Council's authorization of force because its outcome was regime change. UN peacekeeping faces new challenges, especially with regard to the protection of civilians, and UN forces have been given revolutionary mandates in several African states. But the 2015 report Uniting Our Strengths reaffirmed that UN peacekeeping is not suited to counter-terrorism or enforcement operations; the UN should turn to regional organizations such as the African Union as first responders in situations of ongoing armed conflict.

Why should the law care about enforcing contracts? We tend to think of a contract as the legal embodiment of a moral obligation to keep a promise. When two parties enter into a transaction, they are obligated as moral beings to play out the transaction in the way that both parties expect. Le 1er décembre 2009, entrait en vigueur le traité de Lisbonne. Par ce biais, la Charte des droits fondamentaux acquérait la valeur contraignante pleine et entière dont elle s'était vu initialement privée lors de sa proclamation par le Parlement européen, le Conseil et la Commission, le 7 décembre 2000. En moins de vingt années, l'application de la Charte a conduit à la production d'une jurisprudence abondante et complexe, tant à l'égard des droits et libertés qu'elle consacre - songeons par exemple au principe non bis idem, à la matière de la protection des données à caractère personnel, ou encore à l'interdiction des discriminations -, qu'en lien avec les clauses transversales qui en gouvernent l'interprétation et la mise en oeuvre : délimitation de son invocablité vis-à-vis des actes étatiques, lien avec la Convention européenne des droits de l'Homme et articulation avec la protection constitutionnelle des droits et libertés. Une synthèse de cet acquis, et des perspectives qu'il laisse entrevoir, a paru utile, voire indispensable. Le présent ouvrage s'y emploie sous la forme d'un commentaire article par article, systématique, de la Charte des droits fondamentaux de l'Union européenne du 7 décembre 2000, telle qu'adaptée le 12 décembre 2007 à Strasbourg, à laquelle l'article 6 du traité sur l'Union européenne confère la même valeur juridique que les traités constitutifs. Chaque commentaire intègre les références doctrinales et jurisprudentielles les plus récentes et les plus pertinentes sur les sujets traités, et opère les renvois aux autres instruments de protection des droits de l'Homme susceptibles d'offrir un éclairage à la Charte.
