Il doppio binario nell'accertamento dei fatti di mafia

L'incessante espansione del fenomeno mafioso ha comportato la progressiva evoluzione delle misure di contrasto del crimine organizzato, secondo linee per lo più sviluppate dalla giurisprudenza, sia nazionale che sovranazionale, che hanno trovato ampio riscontro in un'intensa produzione legislativa. La frequente elusione delle garanzie penali e processuali di rango costituzionale ha concorso a dare origine alla creazione di un sottosistema normativo cadenzato dal varo di periodici "pacchetti sicurezza" che, di volta in volta, hanno modificato le fattispecie normative ed introdotto nuove figure di misure ablative patrimoniali, di pari passo con un significativo inasprimento sanzionatorio poco rispettoso dei criteri di razionale dosimetria della pena. L'adozione della politica del "doppio binario", quale risposta dell'ordinamento alle attività illecite di sempre più agguerriti sodalizi criminosi, ha progressivamente determinato l'erosione di tradizionali profili dogmatici d'istituti di diritto penale sostanziale e processuale ed allo stesso tempo il concreto rischio di contaminazione dell'intero sistema penale. L'opera si propone di individuare le linee specifiche del regime normativo delle fattispecie associative e della relativa disciplina che governa il giudizio.

There are frequent claims that the international legal regulation of international law is uncertain, vague, ambiguous, or indeterminate, which does not support the stability, transparency, or predictability of international legal relations. This monograph examines the framework of interpretation in international law based on the premise of the effectiveness and determinacy of international legal regulation, which is a necessary pre-requisite for international law to be viewed as law. 
This study examines this problem for the first time since these questions were addressed, and taken as the basic premises of the international legal analysis, in the works of JL Brierly and Sir Hersch Lauterpacht. Addressing the different aspects of the effectiveness of legal regulation, this monograph explores the structural limits on, and threshold of, legal regulation, and the relationship between the established legal regulation and non-law. Once the limits of legal regulation are ascertained, the analysis proceeds to study the legal framework of interpretation that serves the maintenance and preservation of the object and intendment of the existing legal regulation. 
The final indispensable stage of analysis is the interpretation of those treaty provisions that embody the indeterminate conditions of non-law. Given that the generalist element of international legal doctrine has been virtually silent on the problem and implications of the effectiveness and determinacy of international legal regulation, this study examines the material accumulated in doctrine and practice for the past several decades, including the relevant jurisprudence of all major international tribunals

Il libro esamina gli effetti giuridici che l'instaurazione di forme di collaborazione reticolare produce sull'applicazione del sistema di tutele predisposto dall'ordinamento a vantaggio del lavoratore subordinato. L'indagine si dipana in quattro tappe. La prima è dedicata a valutare in che modo la creazione di rapporti di collaborazione reticolare è suscettibile di incidere sulla nozione di datore di lavoro, alterando la formale imputazione del contratto di lavoro o ponendo responsabilità in capo a soggetti estranei al rapporto di lavoro. La seconda parte è dedicata all'esame degli strumenti che meglio di altri appaiono funzionali a favorire l'acquisizione e la circolazione del lavoro all'interno della rete per fronteggiarne le esigenze produttive ed organizzative. Particolare attenzione viene dedicata in quest'ambito alla facoltà di assumere congiuntamente il lavoratore recentemente riconosciuta alle imprese stipulanti il contratto di rete. Nella terza parte sono ricostruiti gli effetti che l'instaurazione di rapporti di collaborazione reticolare produce sui diritti e sugli obblighi delle parti del contratto di lavoro. Sotto il titolo "Assicurazione per conto altrui o per conto di chi spetta" il disposto di cui all'art. 1891 c.c. trova opportuna collocazione tra i due poli dell'interesse (in senso tecnico-assicurativo) e del principio indennitario. È una dialettica centrale nelle problematiche civilistiche: essa, ponendosi in equilibrio tra criterio formale di legittimazione (es. possesso della polizza) e criterio sostanziale di titolarità dell'interesse assicurato, contribuisce a mantenere vivo il dibattito in un settore, quello assicurativo, da sempre foriero di idee nuove e pronto nel dare risposte adeguate alle esigenze che provengono dalla società, sia essa quella mercantile del XIV secolo o quella globalizzata odierna. Tutto ciò in ragione della duttilità che rende l'assicurazione inossidabile e che induce un sempre maggiore ricorso alla stessa. Ma l'assicurazione, pur incline all'interdisciplinarietà, per rimanere nell'alveo che le è proprio e continuare a svolgere il ruolo precipuo che ormai le viene riconosciuto, deve mantenere la propria identità di strumento principe di governo dei rischi evitando di tramutarsi in mezzo attraverso cui ottenere un ingiustificato arricchimento.

The Son Also Rises: Surnames and the History of Social Mobility

How much of our fate is tied to the status of our parents and grandparents? How much does this influence our children? More than we wish to believe. While it has been argued that rigid class structures have eroded in favor of greater social equality, The Son Also Rises proves that movement on the social ladder has changed little over eight centuries. Using a novel technique--tracking family names over generations to measure social mobility across countries and periods--renowned economic historian Gregory Clark reveals that mobility rates are lower than conventionally estimated, do not vary across societies, and are resistant to social policies. The good news is that these patterns are driven by strong inheritance of abilities and lineage does not beget unwarranted advantage. The bad news is that much of our fate is predictable from lineage. Clark argues that since a greater part of our place in the world is predetermined, we must avoid creating winner-take-all societies.
Clark examines and compares surnames in such diverse cases as modern Sweden, fourteenth-century England, and Qing Dynasty China. He demonstrates how fate is determined by ancestry and that almost all societies--as different as the modern United States, Communist China, and modern Japan--have similarly low social mobility rates. These figures are impervious to institutions, and it takes hundreds of years for descendants to shake off the advantages and disadvantages of their ancestors. For these reasons, Clark contends that societies should act to limit the disparities in rewards between those of high and low social rank.
Challenging popular assumptions about mobility and revealing the deeply entrenched force of inherited advantage, The Son Also Rises is sure to prompt intense debate for years to come.

"To speak of human rights is to speak of proportionality. It is no exaggeration to claim that proportionality has overtaken rights as the orienting idea in contemporary human rights law and scholarship. Proportionality has been received into the constitutional doctrine of courts in continental Europe, the United Kingdom, Canada, New Zealand, Israel, and South Africa, as well as the jurisprudence of treaty-based legal systems like the European Court of Human Rights, giving rise to claims of a global model, a received approach, or, simply, the best-practice standard of rights adjudication. Even in the United States, which is widely understood to have formally rejected proportionality, some argue that the various levels of scrutiny adopted by the US Supreme Court are analogous to the standard questions posed by proportionality. As proportionality scholars are well aware, some of the early literature on balancing and rights is American, with special reference to the First Amendment. Notwithstanding proportionality's popularity, there is no consensus on its methodology. Much less does the use of a proportionality doctrine guarantee consensus on substantive rights questions. What the principle of proportionality promises is a common analytical framework, a framework the significance of which is not in its ubiquity (a mere fact), but because its structure influences (some would say controls) how courts reason to conclusions in many of the great moral and political questions confronting political communities. L'attuale senso comune ritiene che si prendono decisioni morali in base a ciò che la società ritiene sia giusto o sbagliato. Questa prospettiva ha consolidato la convinzione che la psicologia morale delle persone sia determinata esclusivamente dall'esperienza e dall'educazione. La tesi di questo libro riconduce la morale alla teoria evolutiva di Charles Darwin: secondo Marc Hauser le regole morali avrebbero una radice profonda e inconscia, da lui definita "grammatica morale universale", sviluppatasi nel corso di milioni di anni, la cui individuazione è possibile grazie all'adozione dei parametri dei più moderni studi di linguistica (con particolare riferimento alla grammatica generativa di Noam Chomsky). Per supportare questa tesi l'autore cita fatti di cronaca, illustra i risultati di test empirici effettuati su oltre 250mila individui di 120 nazioni differenti e valuta la conoscenza morale nei casi di psicopatologie, individuando i momenti fondamentali della storia della filosofia morale.

Le discipline che studiano il cervello umano (dalle neuroscienze alla sociologia, dall'economia comportamentale alla psicologia) hanno ormai scardinato la concezione secolare dell'uomo come entità divisa: da un lato la ragione a comandare, dall'altro le passioni da controllare. Un disegno che non rende conto della meravigliosa profondità dell'essere umano, e che anzi ha causato danni sul piano sociale, politico ed economico. Ma nell'essere umano, animale culturale dotato di specifiche capacità cognitive, i rapporti con gli altri chiamano in causa anche complesse costruzioni mentali e categorie che possono negare quell'umanità che la biologia ci ha programmato a riconoscere. Le predisposizioni biologiche andrebbero quindi sostenute dalla cultura e dai suoi valori e coltivate dall'educazione, soprattutto in famiglia e a scuola

Perché punire è necessario

Le ultime grandi discussioni collettive sul diritto penale e la sua legittimità risalgono agli anni settanta: Hassemer ne era già protagonista allora. Lo stato all'epoca appariva come un Leviatano che puniva i dissidenti e i difformi, occorreva perciò proteggersene e costruire solide garanzie a tutela dei diritti individuali. Da qui le tante proposte di depenalizzazione, di ridimensionamento o abolizione dell'intervento penale che hanno contraddistinto il dibattito per quasi quarant'anni e la lunga serie di delegittimazioni dei processi e della magistratura. Con quest'opera della maturità, priva di tecnicismi e diretta a un pubblico generale, Hassemer prende atto del cambiamento culturale sotteso alla lotta contro il male nelle società attuali: lo Stato non è più un nemico ma un partner, privilegiato, del cittadino; la tutela penale serve a rafforzare i comportamenti leciti; senza punizioni la convivenza sociale sarebbe sfrenatamente brutale.

Nella storia tutte le forme di potere (clan, imperi, istituzioni religiose o politiche) si sono dotate di un corpo scelto di propri guardiani che ne garantiscono la difesa e la perpetuazione. Accade però che le finalità istituzionali cedano il passo a quelle di casta, che il prestigio guadagnato con la fedeltà di molti sia compromesso dai crimini di pochi, fattisi esperti di ricatto, corruzione, trame politiche e d'alcova. Tutti i "guardiani", militari e non militari - siano essi eunuchi, pretoriani, giannizzeri, carabinieri, hackers - hanno capito che per mantenere il controllo sul potere non è necessario assumerlo direttamente: basta infiltrarsi e brigare tra la sfera pubblica e quella privata, tra sicurezza interna ed esterna, governo centrale e amministrazione locale, ideologia e prassi, etica e abuso. Ma non è detto che funzioni per sempre.

Il doppio binario nell'accertamento dei fatti di mafia

L'incessante espansione del fenomeno mafioso ha comportato la progressiva evoluzione delle misure di contrasto del crimine organizzato, secondo linee per lo più sviluppate dalla giurisprudenza, sia nazionale che sovranazionale, che hanno trovato ampio riscontro in un'intensa produzione legislativa. La frequente elusione delle garanzie penali e processuali di rango costituzionale ha concorso a dare origine alla creazione di un sottosistema normativo cadenzato dal varo di periodici "pacchetti sicurezza" che, di volta in volta, hanno modificato le fattispecie normative ed introdotto nuove figure di misure ablative patrimoniali, di pari passo con un significativo inasprimento sanzionatorio poco rispettoso dei criteri di razionale dosimetria della pena. L'adozione della politica del "doppio binario", quale risposta dell'ordinamento alle attività illecite di sempre più agguerriti sodalizi criminosi, ha progressivamente determinato l'erosione di tradizionali profili dogmatici d'istituti di diritto penale sostanziale e processuale ed allo stesso tempo il concreto rischio di contaminazione dell'intero sistema penale. L'opera si propone di individuare le linee specifiche del regime normativo delle fattispecie associative e della relativa disciplina che governa il giudizio.
