Il
volume offre un articolato quadro analitico e concettuale per lo studio
delle relazioni industriali, con un costante riferimento all'esperienza
italiana, europea e sovranazionale, nel mutevole contesto della
globalizzazione. I contributi classici della disciplina e le analisi più
recenti consentono di sviluppare i temi centrali del campo di studi -
rappresentanza, contrattazione, conflitto - e di affrontare la
variabilità delle relazioni industriali nell'impresa, la specificità
della regolazione del lavoro nel settore pubblico e la dimensione
europea, con la sua crescente importanza per i sistemi nazionali di

Crises des réfugiés, crise de l'Union européenne ? : Colloque, Nice, 9 et 10 juin 2016
Face à une pression migratoire
sans précédent depuis la Seconde Guerre mondiale, l'Union tente d'apporter une
réponse européenne à un drame humain qui plonge principalement ses racines dans
l'effondrement moyen-oriental. Sur fond de "polycrises", la crise des
réfugiés est devenue "une priorité absolue", pour reprendre les
termes du discours sur l'état de l'Union prononcé par Jean-Claude Juncker le 9
septembre 2015. De fait, les institutions européennes ont lancé toute une série
d'initiatives pour renforcer la protection des personnes et procéder à la
relocalisation ou à la réinstallation des réfugiés sur des bases équitables.
Des fonds importants ont été débloqués pour aider les Etats se trouvant en
première ligne à assumer leurs obligations. Ces efforts n'ont pas été couronnés
de succès, loin s'en faut. La crise des réfugiés a mis à nu les failles du système
commun d'asile, l'incomplétude de la surveillance des frontières extérieures,
les faiblesses de la politique migratoire de l'UE envisagée tant dans son volet
interne qu'externe, l'inadaptation à l'urgence des procédures de prise de
décision et l'incapacité de l'Union de peser sur le règlement du dossier
syrien. Cependant, le défi le plus redoutable auquel est confrontée l'Union est
l'explosion des égoïsmes nationaux, alimentés par la montée du populisme
partout en Europe. La méconnaissance par les Etats de la solidarité, à la fois
principe et objectif constitutionnel de l'UE, revêt une dimension inédite dans
l'histoire de la construction européenne. Elle rejaillit sur l'Union dans son
ensemble, dont elle ternit l'image en tant qu'entité soumise au droit et
respectueuse des droits fondamentaux. A force de pratiquer le chacun pour soi,
les 28 sont condamnés à des solutions de repli, illustrées par la déclaration
UE-Turquie du 18 mars 2016, qui comportent des aléas à la fois en termes de
légalité, d'autonomie d'action et d'efficience, sans compter leur coût
financier. L'objet du colloque est d'analyser ces différentes problématiques
juridiques sous-jacentes à "la crise des réfugiés". Il s'agit non
seulement de procéder à leur identification mais de mettre en relief leur
interconnexion ainsi que leurs implications concernant l'Union. La réflexion
collective porte également sur les nouvelles orientations qu'appellent les
diverses politiques concernées et sur l'inévitable refondation de la
construction européenne.

Die
nach dem Ersten Weltkrieg neu entstehenden Staaten Ostmitteleuropas
ubernahmen zunachst das bislang auf ihrem Territorium geltende Recht.
Jedoch wurde schon bald die Schaffung einer eigenen, einheitlichen
Zivilrechtsordnung angestrebt. Die Arbeiten blieben aber zumeist im
Entwurfsstadium stecken. Diese Entwurfe stehen an einer Schwelle.
Einerseits sind sie die vielleicht letzten grossen Leistungen des
Zeitalters der liberalen Zivilrechtskodifikationen, andererseits
enthalten sie auch soziale oder paternalistische Tendenzen, die den
Ubergang zum heutigen sozialen Privatrecht markieren. Allen Entwurfen
ist gemeinsam, dass sie sich durch hohe Qualitat auszeichnen. Diese
Zivilgesetzbuchentwurfe der Zwischenkriegszeit werden hier erstmals

Strangers in the Land: Patterns of American Nativism, 1860-1925

Higham's
work stands as the seminal work in the history of American nativism.
The work is a careful, well-documented study of nationalism and ethnic
prejudice, and chronicles the power and violence of these two ideas in
American society from 1860 to 1925. He significantly moves beyond
previous treatments of nativism, both in chronology and in interpretive
sophistication. Higham defines nativism as a defensive type of
nationalism or an intense opposition to an internal minority on the
grounds of the group's foreign connections. By defining nativism as a
set of attitudes or a state of mind, he sets the course for his book as
tracing "trace an emotionally charged impulse" rather than "an actual
social process or condition." As he argues that the ideological content
of nativism remained consistent, he uses emotional intensity as a
measure to trace in detail public opinion from the relative calm
following the Civil War to the Johnson-Reed act of 1924 that severely
limited European immigration.
Strangers in the Land is, then, a history of public opinion, whose purpose is to show how nativism evolved in society and in action. Higham seeks to explain what could inflame xenophobia and who resisted it. He saw his work as part of a renewed interest in the study of nationalism following the national upheavals in the wake of the McCarthy hearings. Surely Higham's mentor at the University of Wisconsin, intellectual historian Merle Curti, influenced Higham's approach in seeking to examine the power of nationalism as an idea. Also influential was the intellectual climate of the 1950s with its of distrust of ideology and distain of prejudice. Higham admits being repelled by the nationalist delusions of the Cold War, again helping to explain why his study concentrates on seeking some explanation for the irrational and violent outbreaks. The book thus focuses on points of conflict, "antagonisms that belong within ideologies of passionate national consciousness." For example, Higham's explains the 100 percent American movement in terms of progressive ideals and the desire of Americans to shape immigrants into a particular ideal of "Americanness" through education and assimilation. This intellectual construct eventually gave way to the racial thinking to which Higham assigns much influence in the efforts to restrict immigration. Ideology is also central to his chapter on the history of the idea of racism in which he argues that Anglo-Saxon nationalism, literary naturalism and a nascent understanding of genetics combined to bring forth arguments for immigration restriction to preserve the racial purity of the American people. Thus, key for Higham's argument is the power of ideas in shaping individual behavior and thereby shaping history.

Poverty, Agency, and Human Rights
Poverty,
Agency, and Human Rights collects thirteen new essays that analyze how
human agency relates to poverty and human rights respectively as well as
how agency mediates issues concerning poverty and social and economic
human rights. No other collection of philosophical papers focuses on the
diverse ways poverty impacts the agency of the poor, the reasons why
poverty alleviation schemes should also promote the agency of
beneficiaries, and the fitness of the human rights regime to secure both
economic development and free agency.
The book is divided into four parts. Part 1 considers the diverse meanings of poverty both from the standpoint of the poor and from that of the relatively well-off. Part 2 examines morally appropriate responses to poverty on the part of persons who are better-off and powerful institutions. Part 3 identifies economic development strategies that secure the agency of the beneficiaries. Part 4 addresses the constraints poverty imposes on agency in the context of biomedical research, migration for work, and trafficking in persons.

nominally protected across Europe, the human rights of vulnerable
migrants often fail to deliver their promised benefits in practice. This
socio-legal study explores both the concrete expressions and possible
causes of this persistent deficit. For this purpose, it presents an
innovative multifaceted evaluation of selected judgments of the European
Court of Human Rights and the Court of Justice of the EU pertaining to
such complex questions as the protection of persons fleeing from
indiscriminate violence, homosexual asylum seekers, the Dublin
Regulation, and the externalisation of border control. Highlighting the
demanding character of migrant rights, the book also discusses some
steps that could be taken to improve the effectiveness of Europe's
supranational human rights system including changes in judicial and

Gegenstand
dieser Untersuchung ist die Kategorie der Realvertrage im romischen
Recht, deren Elemente nach herrschender Meinung das Darlehen (mutuum),
die Leihe (commodatum), die Verwahrung (depositum) und das Faustpfand (
pignus ) sind. Sie wurzelt in der mittelalterlichen Rechtswissenschaft
(sog. contractus re). Die romische Jurisprudenz kannte jedoch nur einen
Entstehungsgrund einer obligatio re contracta , namlich das mutuum , da
fur die romischen Juristen das re contrahere durch eine
Eigentumsubertragung an einer Sache (datio rei) charakterisiert war,
nicht durch eine blosse Sachhingabe. Unsere Quellen sprechen massgeblich
dafur, dass die intellektuelle Heimat der Realvertraglichkeitvon
commodatum, depositum und pignus nicht im klassischen romischen Recht zu
finden ist. Die romische Kategorie der Realvertrage, so wie wir sie uns
vorstellen, stellt ein falsches retrospektives Konstrukt dar.

Scaevola noster: Schulgut in den 'libri disputationum' des Claudius Tryphoninus?

Stepan widmet sich der Lehrer-Schuler-Beziehung zweier Juristen der
zweiten Halfte des 2. Jh. und der ersten Halfte des 3. Jh. nach
Christus. Er geht dabei der Frage nach, wie man uberhaupt Erkenntnisse
uber die Qualitat einer solchen Beziehung gewinnen kann. Anders als bei
den Angehorigen der Rechtsschulen der Sabinianer und Proculianer fehlt
es an Quellen, die uber die Juristen dieser Zeit berichten.
Ausgangspunkt konnen daher nur die Quellen der zu untersuchenden
Juristen selbst sein. Das Ergebnis ist eine Methode, die anhand
zahlreicher Vergleichsstellen aus den Themengebieten des peculium
castrense , der Mitgift (dos) , des Begriffes des debitum , der
Umstossung von (Soldaten-) Testamenten, der Kurzung von Vermachtnissen
nach der lex Falcidia sowie der Ersitzung zugunsten des Kriegsgefangenen
oder dessen Erben einen Einfluss des Q. Cervidius Scaevola auf seinen
Schuler Claudius Tryphoninus plausibel macht.
