The Politics of Water in Africa:
Norms, Environmental Regions and
Transboundary Cooperation in the Orange-Senqu and Nile Rivers

Water resources and related issues are of great significance in 21st century politics. In Africa, for example, hydropolitics affect politics and policymaking at the local, national, and international levels. To investigate water politics, this unique work focuses on the issue transboundary water governance in Southern and Eastern Africa.
Based on extensive field research, it offers a comparative study of the Orange Senqu and Nile basins in Africa, arguing that both causal and behavioral factors (such as localization and trust building) drive the multi-leveled development of cooperative management norms and foster the creation of regional communities of interest.
The book combines theory, analysis, and fieldwork within the framework of Constructivism as well as a wide range of examples to identify and analyze the nature of norms in hydropolitics. By doing so, it will help shape the debate on how water conflict and cooperative governance should evolve and will interest anyone studying African politics, hydropolitics, and issues of development.

Consequential Courts

In the early twenty-first century, courts have become versatile actors in the governance of many constitutional democracies, and judges play a variety of roles in politics and policy making. Assembling papers penned by academic specialists on high courts around the world, and presented during a year-long Andrew W. Mellon Foundation John E. Sawyer Seminar at the University of California, Berkeley, this volume maps the roles in governance that courts are undertaking and the ways they have come to matter in the political life of their nations. It offers empirically rich accounts of dramatic judicial actions in the Americas, Europe, the Middle East and Asia, exploring the political conditions and judicial strategies that have fostered those assertions of power and evaluating when and how courts' performance of new roles has been politically consequential. By focusing on the content and consequences of judicial power, the book advances a new agenda for the comparative study of courts.

This new book advances a fresh philosophical account of the relationship between the legislature and courts, opposing the common conception of law, in which it is legislatures that primarily create the law, and courts that primarily apply it. This conception has eclectic affinities with legal positivism, and although it may have been a helpful intellectual tool in the past, it now increasingly generates more problems than it solves. For this reason, the author argues, legal philosophers are better off abandoning it. At the same time they are asked to dismantle the philosophical and doctrinal infrastructure that has been based on it and which has been hitherto largely unquestioned. The book offers an alternative framework for understanding the role of courts and the legislature; a framework which is distinctly anti-positivist and which builds on Ronald Dworkin's interpretive theory of law. But, contrary to Dworkin, it insists that legal duty is sensitive to the position one occupies in the project of governing; legal interpretation is not the solitary task of one super-judge, but a collaborative task structured by principles of institutional morality such as separation of powers which impose a moral duty on participants to respect each other's contributions. Moreover this collaborative task will often involve citizens taking an active role in their interaction with the law.

Die libri disputationum des Claudius Tryphoninus
Eine spätklassische Juristenschrift

Die Verfasserin untersucht den Werkcharakter und die Textgeschichte der libri disputationum des spätklassischen Juristen Claudius Tryphoninus, einer bislang wenig beachteten, zu Beginn des dritten Jahrhunderts n. Chr. verfaßten römischen Juristenschrift. Ein Werk gleichen Titels ist nur noch von Ulpian bekannt. Nach dem Werktitel hat man vermutet, daß den libri disputationum streitige Erörterungen zugrunde lagen. Sie werden den quaestiones an die Seite gestellt, sollen aber deutlicher als diese den Ursprung im Rechtsunterricht erkennen lassen. Nach verbreiteter Auffassung zeigen die in den Digesten überlieferten Fragmente tiefe Spuren nachklassischer Überarbeitung; vereinzelt wird Tryphonins Urheberschaft überhaupt in Zweifel gezogen.

Die Untersuchung besteht im Haupteil aus ausführlichen Exegesen einer repräsentativen Auswahl der überlieferten Digestenfragmente. Ihre Gliederung bestimmen formale Kriterien, da sich die Texte durchweg mehr oder weniger festen, nach ihren jeweiligen Eigentümlichkeiten benannten Darstellungsformen zuordnen lassen (Traktate, Kommentare, Distinktionen, Dialoge). Die Autorin kommt zu dem Ergebnis, daß die libri disputationum nicht für die juristische Praxis bestimmt sind. Sie verfolgen vielmehr theoretische Absichten und sind Beiträge zur gelehrten Diskussion. Ihr Interesse ist Rechtserkenntnis, ihr Medium die Fallerörterung. Daneben ist auch ein pädagogisches Interesse nicht zu übersehen, so daß die libri disputationum zugleich eine anspruchsvolle juristisch-pädagogische Anleitung darstellen. Nicht bestätigt wird die extreme Kritik der überlieferten Texte. Zwar ist Tryphonins Text weder in den dreihundert Jahren vor der justinianischen Kompilation noch bei deren Herstellung unberührt geblieben. Von einer tiefgreifenden Überarbeitung oder gar vollkommenen Umgestaltung des klassischen Textes kann jedoch keine Rede sein.

The comparative study of labor law systems has been an important field of law for many decades, but now, as production becomes increasingly global, issues of comparative labor law arise with a new urgency. The papers in this volume explore all facets of comparative work in the labor law field, addressing questions such as, what was the purpose of engaging in the study of comparative labor law in the past, and what is the purpose of such an inquiry today? Are national labor law systems converging in the face of the increasing globalization of production in recent decades? How are different countries responding to current challenges to their domestic labor law regimes, challenges such as the advent of new flexible models of production, an increase in immigration, and domestic participation in transnational trading blocs? Labor law scholars from eight countries, spanning several generations, met at the UCLA School of Law in the fall of 2005 to consider these and other questions. The papers in this volume present the ideas exchanged and invite yet further reflection on the goals, purposes, possibilities and pitfalls of comparative work in the labor law field.

Il principio di sussidiarietà ha avuto un notevole rilievo nel discorso politico e giuridico degli ultimi anni. Tuttavia, non sempre l'attenzione si è soffermata a fondo sui problemi di ordine teorico e pratico che esso pone. La modifica del primo comma dell'art. 117 della Costituzione, nel prevedere che la potestà legislativa è esercitata nel rispetto - tra l'altro - dei vincoli derivanti dall'ordinamento comunitario e dagli obblighi internazionali, non si è limitata ad introdurre un limite per la legislazione, ma ha ricadute anche sull'amministrazione ed in particolare sulla funzione amministrativa, quale effettivo svolgersi del potere pubblico. Ne risulta modificato il collegamento tra la funzione e l'insieme delle finalità di essenziale rilievo nell'azione dello Stato. L'art. 117, in altri termini, favorisce una rilettura della funzione amministrativa in chiave di effettività e di giustizia sostanziale, soprattutto tramite la legittimazione attraverso i diritti umani.
