An Uncertain Glory: India and its Contradictions

When India became independent in 1947 after two centuries of colonial rule, it immediately adopted a firmly democratic political system, with multiple parties, freedom of speech, and extensive political rights. The famines of the British era disappeared, and steady economic growth replaced the economic stagnation of the Raj. The growth of the Indian economy quickened further over the last three decades and became the second fastest among large economies. Despite a recent dip, it is still one of the highest in the world.
Maintaining rapid as well as environmentally sustainable growth remains an important and achievable goal for India. In An Uncertain Glory, two of India's leading economists argue that the country's main problems lie in the lack of attention paid to the essential needs of the people, especially of the poor, and often of women. There have been major failures both to foster participatory growth and to make good use of the public resources generated by economic growth to enhance people's living conditions. There is also a continued inadequacy of social services such as schooling and medical care as well as of physical services such as safe water, electricity, drainage, transportation, and sanitation. In the long run, even the feasibility of high economic growth is threatened by the underdevelopment of social and physical infrastructure and the neglect of human capabilities, in contrast with the Asian approach of simultaneous pursuit of economic growth and human development, as pioneered by Japan, South Korea, and China.

In a democratic system, which India has great reason to value, addressing these failures requires not only significant policy rethinking by the government, but also a clearer public understanding of the abysmal extent of social and economic deprivations in the country. The deep inequalities in Indian society tend to constrict public discussion, confining it largely to the lives and concerns of the relatively affluent. Drèze and Sen present a powerful analysis of these deprivations and inequalities as well as the possibility of change through democratic practice

The Nature of Supreme Court Power

Few institutions in the world are credited with initiating and confounding political change on the scale of the United States Supreme Court. The Court is uniquely positioned to enhance or inhibit political reform, enshrine or dismantle social inequalities, and expand or suppress individual rights. Yet despite claims of victory from judicial activists and complaints of undemocratic lawmaking from the Court's critics, numerous studies of the Court assert that it wields little real power. This book examines the nature of Supreme Court power by identifying conditions under which the Court is successful at altering the behavior of state and private actors. Employing a series of longitudinal studies that use quantitative measures of behavior outcomes across a wide range of issue areas, it develops and supports a new theory of Supreme Court power. Matthew E. K. Hall finds that the Court tends to exercise power successfully when lower courts can directly implement its rulings; however, when the Court must rely on non-court actors to implement its decisions, its success depends on the popularity of those decisions. Overall, this theory depicts the Court as a powerful institution, capable of exerting significant influence over social change.

The Failure of Capitalist Production: Underlying Causes of the Great Recession

The recent financial crisis and Great Recession have been analyzed endlessly in the mainstream and academia, but this is the first book to conclude, on the basis of in-depth analyses of official U.S. data, that Marx’s crisis theory can explain these events.
 
Marx believed that the rate of profit has a tendency to fall, leading to economic crises and recessions. Many economists, Marxists among them, have dismissed this theory out of hand, but Andrew Kliman’s careful data analysis shows that the rate of profit did indeed decline after the post-World War II boom and that free-market policies failed to reverse the decline. The fall in profitability led to sluggish investment and economic growth, mounting debt problems, desperate attempts of governments to fight these problems by piling up even more debt – and ultimately to the Great Recession.
 
Kliman's conclusion is simple but shocking: Short of socialist transformation, the only way to escape the "new normal" of a stagnant, crisis-prone economy is to restore profitability through full-scale destruction of existing wealth, something not seen since the Depression of the 1930s

La motivation des décisions des cours suprêmes et cours constitutionnelles

La motivation n'est pas forcément la reproduction du cheminement suivi par le juge afin d'arriver au jugement final. Ce décalage entre les contextes décisoire et justificatif ne peut être comblé, néanmoins cela n'interdit pas de s'intéresser à la motivation pour ce qu'elle donne à voir. C'est au final l'idée que s'en fait le juge qui mérite l'attention et donc ce qu'il en dit à travers ses décisions. C'est cette idée qu'il faut interroger dans ses arguments, sa structure, et sans doute ses silences. La motivation écrite n'est pas tout, mais elle compte car les juristes évoluent dans un monde formel et rationnel. L'approche privilégiée dans cet ouvrage est celle du comparatisme qui favorise une mise à distance de l'objet d'étude et le développement d'un point de vue critique. L'étude des cours constitutionnelles ou des cours suprêmes évoluant en tradition civiliste et de common law permet d'aborder la question de la motivation en s'interrogeant sur un éventuel rapprochement des traditions même si, d'un côté, la jurisprudence comme source du droit n'est reconnue qu'à titre complémentaire alors que de l'autre la motivation représente un moment fort dans la création jurisprudentielle du droit. Il y a en effet des différences qui restent prégnantes et qui structurent donc le débat doctrinal et se révèlent lourdes de conséquences pour l'office du juge. La plupart des contributions réunies dans cet ouvrage présentent néanmoins la motivation comme un instrument de légitimation du discours du juge. Cette idée transcende à présent les traditions juridiques. En ce sens, le syllogisme procédé de justification afin de présenter la décision comme évidente et objective est désormais assez largement écarté même dans la tradition civiliste dès lors que l'on s'intéresse aux cours suprêmes et aux cours constitutionnelles.

All’inizio, lo studio del diritto sembra un labirinto inestricabile: e rischia di restarlo, senza appositi fili d’Arianna. Questa Introduzione allo studio del diritto fornisce cinque idee semplici – una per capitolo – che aiutano a orientarsi nel labirinto. Anzitutto, il diritto si distingue dalla morale perché serve a guidare la condotta, non a valutarla. Poi, la parola ‘diritto’ indica norme prodotte e applicate da istituzioni in base a costituzioni, trattati e carte dei diritti. Vi sono, quindi, due tipi di norme giuridiche: le regole, che guidano la condotta, e i principi, che dicono come devono essere fatte le regole. Ancora, l’insieme delle norme giuridiche viene raffigurato dalla dottrina come ordinato: come un sistema. Infine, si possono applicare le norme giuridiche solo dopo averne interpretato le formulazioni o disposizioni.
A ogni capitolo seguono domande ed esercizi, che aiutano pure loro. Ma non a uscire dal labirinto: semmai, a percorrerlo in lungo e in largo, senza restare intrappolati

The close connection between philosophy of language and philosophy of law has been recognized for decades through the work of many influential legal philosophers. This volume brings recent advances in philosophy of language to bear on contemporary debates about the nature of law and legal interpretation.

The book builds on recent work in pragmatics and speech-act theory to explain how, and to what extent, legal content is determined by linguistic considerations. At the same time, the analysis shows that some of the unique features of communication in the legal domain - in particular, its strategic nature - can be employed to put pressure on certain assumptions in philosophy of language. This enables a more nuanced picture of how semantic and pragmatic determinants of communication work in complex and large-scale systems such as law.

Chapters build on explanations of key elements of statutory language, such as the distinction between what is said and what is implicated, the possibility of ascribing truth-values to legal prescriptions and the structure of legal inferences, the various forms of vagueness in the law, the distinctions between vagueness, ambiguity, and polysemy in legal language, and the distinction between concept and conceptions, mostly in the context of constitutional interpretation. The book demonstrates that paying close attention to the kind of speech acts legal directives are, and how they determine the content of the law, enables a better understanding of the boundaries between normative and linguistic determinants of legal content

Torture and Moral Integrity is about the wrongness of torture and the nature of morality. It discusses multiple types of torture with great philosophical acuity and it seeks to explain why interrogational torture and other types of torture are always and everywhere morally wrong. At the same time, it rigorously plumbs the general structure of morality and the intricacies of moral conflicts and it probes some of the chief grounds for the moral illegitimacy of various modes of conduct. It sophisticatedly defends a deontological conception of morality against some subtle critiques that have been mounted during the past few decades by proponents of consequentialism. 
The book tackles a concrete moral problem: a problem that has been heatedly debated during recent years in the governmental and military institutions of many countries as well as in academic circles. At the same time it tackles some very abstract issues in moral and political philosophy. Moreover, as becomes apparent at numerous junctures, the abstract ruminations and the concrete prescriptions are closely connected: Kramer's recommendations concerning the legal consequences of the perpetration of torture by public officials or private individuals, for example, are based squarely on his more abstract accounts of the nature of torture and the nature of morality. His philosophical reflections on the structure of morality are the vital background for his approach to torture, and his approach to torture is a natural outgrowth of those philosophical reflections

In recent years the impact of human rights and fundamental rights on private law has risen in prominence and led to a whole series of detailed investigations. 'Constitutionalization of private law' is the flag under which most of the research on the increasing impact of national constitutional rights on national private legal orders is sailing.

In the absence of a European Constitution, the constitutionalization of European private law suggests a process: constitutionalization instead of constituent power, demos, and the magic constitutional moment. The Charter of Fundamental Rights and the European Convention of Human Rights constitute the two pillars on which the transformation of European private law rests.

This volume clearly demonstrates the change that has taken place, at the national and at the European level. Private law is no longer immune to the intrusion of fundamental and human rights. Interactions between state, international, transnational and intra-state law involve overlapping, and sometimes conflicting, claims to legitimate authority. These have led scholars to new theoretical explanations of sovereignty, constitutionalism, and legality, but there has been no close attention to authority itself. This book asks whether, and under what conditions, there can be multiple legitimate authorities with overlapping or conflicting domains. Can legitimate authority be shared between state, supra-state and non-state actors, and if so, how should they relate to one another? Roughan argues that understanding authority in contemporary pluralist circumstances requires a new conception of relative authority, and a new theory of its legitimacy. The theory of relative authority treats the interdependence of authorities, and the relationships in which they are engaged, as critical to any assessment of their legitimacy. It offers a tool for evaluating inter-authority relationships prevalent in international, transnational, state and non-state constitutional practice, while suggesting significant revisions to the idea that law, in general or even by necessity, claims to have legitimate authority

Viviamo in tempi sempre più incerti e difficili. Certezze d'un tempo si stanno sgretolando insieme allo Stato sociale cui queste erano collegate. E lo Stato sociale si fa fragile perché è la sua qualità principale ad essere attaccata e rimaneggiata al ribasso, la capacità di ascrivere diritti sociali ai cittadini e sì pure agli stranieri, ché i diritti sociali sono stati pensati almeno in via di principio come universali. Tutto ciò però è teoricamente e politicamente controverso. Nelle due lezioni che qui si pubblicano è questo il tema che si affronta, della pregnanza e complessità, concettuale ed istituzionale, di strumenti che la cittadinanza si era data per accedere ad un modello di ordine politico imperniato sulla ridistribuzione della ricchezza e del potere materiale
