Social Rights Judgments and the Politics of Compliance: Making it Stick

The past few decades have witnessed an explosion of judgments on social rights around the world. However, we know little about whether these rulings have been implemented. Social Rights Judgments and the Politics of Compliance is the first book to engage in a comparative study of compliance of social rights judgments as well as their broader effects. Covering fourteen different domestic and international jurisdictions, and drawing on multiple disciplines, it finds significant variance in outcomes and reveals both spectacular successes and failures in making social rights a reality on the ground. This variance is strikingly similar to that found in previous studies on civil rights, and the key explanatory factors lie in the political calculus of defendants and the remedial framework. The book also discusses which strategies have enhanced implementation, and focuses on judicial reflexivity, alliance building and social mobilisation.

Should the criminal law be used to deter and punish corruption in politics: from employing family members at public expense to improper spending on elections, lobbying, and cronyism? How did so many MPs avoid facing charges after the 2009 government expenses scandal? In this book, Jeremy Horder tackles these questions and more. As well as offering the first treatment of the history, philosophy, and politics of the application of the offence of misconduct in office to Members of Parliament in England and Wales, Horder explains how political corruption might be dealt with in future, and how politicians could be held accountable for their actions so that they are deterred from betraying the public's trust. Use of the criminal law should not be the sole or even the main way to remedy all corruption in politics. Nevertheless, for too long the offence of misconduct in a public office has had an ambiguous status in the political realm. If we are to preserve the good health of government it must be seen as a constitutional fundamental. A charge of misconduct provides a way in which corrupt conduct on the part of legislators can be punished with an appropriate label, holding them to account for the misuse of power by reference to the standards of ordinary people. When other - civil law or regulatory - means prove insufficient, it should be possible for ordinary members of a jury, and not for Parliamentarians or other officials, to decide whether, for example, the expenditure of public money on legislators' private income and benefits amounts to a criminal abuse of the public's trust. This book offers an authoritative and accessible account of a 'bottom-up' (jury standards-led), as opposed to a 'top-down' (officials applying their own standards), approach to the role of the criminal law in constitutional contexts.

Questo volume persegue l'obiettivo di fare il punto sullo "stato di salute" del nuovo diritto penale tributario, recentemente introdotto con il d.lgs. 158/2015, per coglierne le ragioni che hanno spinto il legislatore a modificare la disciplina vigente di cui al d.lgs. 74/2000. Come è noto invero la riforma del 2000 aveva rotto i ponti con il sistema delle condotte incriminate dalla l. 516/1982 e aveva focalizzato l'intervento riformistico su poche fattispecie penali, riportando sostanzialmente il diritto tributario penale nella casa comune del diritto penale, amalgamando così scelte e tecniche di costruzione delle fattispecie penale. Ma le opzioni normative successive alla riforma del 2000 ne avevano, purtroppo, ridimensionato le strategie soprattutto con innesti normativi svincolati dai criteri direttivi della legge delega e con l'utilizzo di tecniche di normativa di tipo casistico, riportando indietro le lancette del diritto penale tributario con l'incriminare nuovamente condotte prodromiche a prescindere da un reale accertamento dell'evasione. Si imponeva allora un nuovo intervento riformistico e non solo per ragioni teoriche ma anche perché la prassi applicativa aveva compiuto in non pochi casi evidenti forzature interpretative del testo normativo per adeguarlo a situazioni contingenti.

Il testo, concepito prevalentemente per gli studenti universitari delle materie giuridiche, si propone di fornire un quadro esaustivo del vigente diritto amministrativo sostanziale, tentando allo stesso tempo di favorirne il rapido apprendimento. Ne è riprova l'originale metodologia prescelta, che punta a conciliare completezza di illustrazione e sintesi concettuale. Rispetto ad analoghi manuali, il testo si segnala per alcune innovative classificazioni e partizioni della materia, elaborate dall'autore per una migliore e più immediata comprensione della disciplina. In tal senso alcune delle categorie del passato meritavano di essere riviste ed ammodernate in considerazione dell'inarrestabile sviluppo che il diritto amministrativo ha conosciuto negli ultimi decenni e continua a conoscere: basti soltanto pensare al recente codice dei contratti pubblici (D.Lgs. n. 50/2016) ed alle riforme che hanno interessato la trasparenza amministrativa, l'accesso civico ed il procedimento amministrativo (il pensiero va soprattutto al D.Lgs. n. 33/2013, nonché alla L. n. 124/2015 ed ai relativi decreti attuativi). Valorizzando l'esperienza didattica vissuta nelle aule universitarie e nelle scuole di specializzazione per le professioni legali, l'autore fa tesoro delle acquisizioni dottrinali e giurisprudenziali che informano la fisionomia degli istituti, riversando nell'opera la propria personale esperienza di avvocato del foro amministrativo. Viene così sviluppato un percorso espositivo insieme critico, coerente ed organico, incentrato su tre cardini fondamentali: enucleazione delle nozioni, loro collocazione sistematica e loro interrelazione. Ne scaturisce una visione d'insieme che guarda al diritto amministrativo del presente e soprattutto del futuro, con un occhio sempre attento alle tendenze evolutive dell'ordinamento.

Cet ouvrage rassemble les actes actualisés des Quatorzièmes Journées Jean Monnet sur « Le statut d’État membre de l’Union européenne », un sujet qui vient à point nommé en cette année anniversaire des traités de Rome et à l’heure du Brexit. Ce statut est situé dans l’ordre constitutionnel de l’Union et rapporté aux processus d’intégration et de fédéralisation qui caractérisent l’Union. Il est conçu comme le socle de la condition juridique de l’État membre de l’Union et se définit comme un ensemble d’engagements, de droits, d’obligations et de garanties inscrits dans les traités et la jurisprudence de la Cour de justice de l’Union. Il est mis à l’étude dans sa singularité rapportée à la singularité de l’Union. Il lie l’État membre et l’Union et agit sur la condition de l’État et de l’Union. Il est analysé en lien avec les valeurs communes, les principes fondamentaux et les objectifs de l’Union. Il s’impose aux États candidats à l’adhésion puis comme statut d’appartenance et de participation à l’ordre juridique de l’Union.

Il est traité comme expression de l’acquis constitutionnel de l’Union et comme facteur de progrès par la dynamique intégrative qui anime sa nature intrinsèque liée à l’essence fédérale de la construction européenne et qui gouverne la participation des États membres aux fonctions et aux politiques de l’Union. Il est donc étudié au regard des avancées des processus d’intégration, de constitutionnalisation et de fédéralisation qui caractérisent l’Union, en soulignant tant leurs évolutions positives que les obstacles qui les affectent ainsi que la possibilité de régressions dans toutes les dimensions et implications constitutionnelles qu’elle comporte. Comme statut commun aux États membres de l’Union, il est rapporté aux processus de différenciation dans l’Union et aux enjeux du droit de retrait introduit par le traité de Lisbonne, mis en exergue par le Brexit.

Il met en lumière la singularité, la permanence, l’affinement et l’enrichissement du statut d’État membre de l’Union, d’un point de vue institutionnel et matériel. Il permet d’identifier la teneur positive et l’interdépendance des droits et obligations que ce statut incarne, leur dualité de substance européenne/nationale, ainsi que leurs variations dans les relations entre l’État membre et l’Union. Il met en évidence les liens et tensions que ce statut exprime, - dans l’ordre interne de l’Union et dans ses relations extérieures -, entre l’Union et ses États, d’une part, et entre les États membres entre eux, d’autre part. Le rôle constitutionnel de la Cour de justice de l’Union ainsi que les apports constitutionnels de la jurisprudence et du « dialogue des juges » occupent une place privilégiée dans les analyses menées.

Die Bibliotheca Teubneriana, gegründet 1849, ist die weltweit älteste, traditionsreichste und umfangreichste Editionsreihe griechischer und lateinischer Literatur von der Antike bis zur Neuzeit. Pro Jahr erscheinen 4-5 neue Editionen. Sämtliche Ausgaben werden durch eine lateinische Praefatio ergänzt.
