Il libro prende in esame la poliedrica concezione della restorative justice o giustizia riparativa per descriverne lo sviluppo e comprenderne le potenzialità evolutive in seno ai sistemi di giustizia punitiva.Questa particolare prospettiva è chiamata ad integrare il modello tradizionale con nuovi strumenti, progressivamente sempre più formalizzati.L'indagine è condotta a partire dalle istanze che sono sottese alla giustizia riparativa, per poi affrontare il panorama normativo sovranazionale ed europeo. Nell'ambito della realtà giuridica italiana lo studio si concentra sul sistema del giudice di pace e si estende quindi agli istituti generali di più recente introduzione che in qualche misura consentono di promuovere esiti e processi riparativi.L'orizzonte di una giustizia penale che, con le dovute cautele, si riappropria di alcuni modelli informali cresciuti al suo esterno e che mira ad essere più riparativa, valorizzando la mediazione penale e la riparazione, è affrontato da tre diversi punti di vista tra loro convergenti, quelli della vittima, del reo e dell'efficienza del sistema.

Nel corso della storia, e da diverse angolazioni, la vendetta è stata definita e interpretata in molti modi. Il presente volume "La giustizia vendicatoria" raccoglie tredici contributi sulla vendetta presentando, in una prospettiva interdisciplinare, studi di autori classici e ricerche contemporanee. L'antologia si articola in due sezioni. La prima, intitolata "Vendetta, composizione, reciprocità", raccoglie sei studi, pubblicati tra il 1881 e il 1970, che affrontano i nodi teorici fondamentali nello studio della vendetta. La seconda, intitolata "Vendetta in azione. Teorie e ricerche contemporanee", raccoglie sette contributi inediti di studiosi contemporanei che indagano il tema della vendetta nella prospettiva dell'antropologia culturale e giuridica, della filosofia del diritto, della criminologia, della storia dei diritti antichi.

Justification and Excuse in International Law: Concept and Theory of General Defences

The defences available to an agent accused of wrongdoing can be considered as justifications (which render acts lawful) or excuses (which shield the agent from the legal consequences of the wrongful act). This distinction is familiar to many domestic legal systems, and tracks analogous notions in moral philosophy and ordinary language. Nevertheless, it remains contested in some domestic jurisdictions where it is often argued that the distinction is purely theoretical and has no consequences in practice. In international law too the distinction has been fraught with controversy, though there are increasing calls for its recognition. This book is the first to comprehensively and thoroughly examine the distinction and its relevance to the international legal order. Combining an analysis of State practice, historical, doctrinal and theoretical developments, the book shows that the distinction is not only possible in international law but that it is also one that would have important practical implications.
